OpenNet Submits Supporting Opinion for the Bills Limiting Factual Defamation to Privacy Invasions

On September 6, 2024, Open Net submitted supporting opinions to the National Assembly regarding two proposed amendments: the Partial Amendment to the Criminal Act (Bill No. 2203388, proposed by Representative Choi Ki-sang) and the Partial Amendment to the Information and Communications Network Act (Bill No. 2203389, also proposed by Representative Choi Ki-sang). The proposed bills aim to limit the scope of criminal liability for factual defamation to cases where such statements infringe upon an individual’s privacy, and to revise defamation offenses to be prosecuted only upon complaint (i.e., as complaint-based offenses).
