K.S. Park explains why Korean FOIA does not work. Korean FOIA law allows regulations to provide for exceptions from disclosure obligations while American FOIA allows only statutes to do so. This allows many minister-level departments and agencies to change their regulations so that the information they hold can be exempt from disclosure. Although these regulations are called “Presidential Decrees”, they are never like American ‘Executive Orders’ which are controlled closely by the White House itself. Read Korean original here.
